A petitioner has filed a case in court challenging the Sports Cabinet Sectary's appointment of the Creatives Technical Committee.
Namwamba had established the committee under the Talanta Hela Council as part of his radical reforms to promote artists and the creative industry.
Mugane Advocates which filed the applications says the committee, chaired by comedian Daniel Ndambuki, popularly known as Churchill is illegal.
Charles Mugane argues Namwamba handpicked the committee members without any parameters including regard for merit.
According to Mugane, the appointments were politically engineered to reward cronies while ignoring qualified Kenyans
'This was a betrayal of the public trust bestowed upon you by the Kenyan citizenry,” Mugane told Namwamba in the petition.
The petitioner further states that the appointments were made in breach of Article 10 of the Constitution.
The Article sets out the national values and principles of governance, including public participation, good governance, transparency and accountability.
"Certainly, no selection process has been shown of how the eleven were arrived at from the massive eight million Kenyans on the TikTok platform where the appointees appear to have been drawn from," read part of the petition.
"Your actions above are a blatant disregard of the law which our client shall not countenance."
Mugane wants to be furnished with evidence of public participation in the establishment of the council and the committee as well as details of the budget for the council the Sports CS.
Namwamba formed the committee on February 11 and the members appointed are to serve for a period of three years.
Digital strategist Dennis Itumbi, Kizito Wangalwa, David Langat, Debra Mallowah, Abraham Kipyego Mutai, Charles Gacheru, Claudia Naisabwa Leshomoo, Nobert Ouma, and June Chepkemei were appointed to the Talanta Hela Council board, chaired by Namwamba himself.
The Creative Technical Committee constitutes Akinyi Odongo, Jimmi Gathu, Catherine Kamau, Esther ‘Akothee’ Akoth, Kizito Makhande, TikToker Azziad Nasenya, Rosemary Wahu Kagwi, Awadhi Salim Awadhi, Douglas Kipkirui, Langat Susan Ekasiba, chaired by comedian Daniel ‘Churchill’ Ndambuki.
Another Committee under the Talanta Hela Council is the Sports Technical Committee consisting of Carol Radul, Boniface Ambani, Julius Kiplagat Yego, Neddy Kutsuru, Alfred Makotsi, Sammy Tiyoi Shollei, Collins Kale, Kevin Mutai, Shilovelo Winna Shilavula, Daniel Nakeor Losiru, and Staicy Shariffa Ochieng.
