The Muchelule-led tribunal ended its hearings today and now focus shifts to their recommendations on Commissioner Irene Masit's suitability.
Justice Aggrey Muchelule said they will now retire to deliberate and make appropriate recommendations to the president as is required by law
However, the tribunal did not indicate when the report will be ready.
In her final submissions to the court, embattled Masit made a final attempt to convince the tribunal that she was innocent.
Through lawyer Donald Kipkorir, Masit said there was no evidence produced to show her culpability and gross misconduct in last year’s presidential polls
Kipkorir said the petition before the tribunal was not based on any law.
On his part, the tribunal lead counsel Peter Munge urged the tribunal to find that Masit is not suitable to be a commissioner and recommend her removal from office.
Munge said Masit does not realise or accept that she breached the law.
He said even though the other three commissioners opted to resign, there is a need to ensure that there is no recurrence of what happened in the August 2022 presidential polls
“What the commissioners did could provoke animosity and interfere with the tranquillity of this nation,” Munge said
Munge said they had proved beyond reasonable doubt that there was a serious violation of the law.
“There is clear evidence that the commissioner took sides in the last presidential polls,” he added.
