In courts today: Itumbi's case on fake Ruto assassination letter to proceed

The case in which former State House digital director Dennis Itumbi was charged over the fake assassination letter of President William Ruto will be mentioned on Monday.

Itumbi was charged with counts of making false documents, publishing false documents and reprogramming a phone.

In the case, Itumbi and his co-accused Samwel Gateri were put on their defence in September last year.

The court found that they had a case to answer and ruled that they will defend themselves.

“Having analyzed the evidence before court I find that the prosecution has proved the case beyond a reasonable doubt to warrant the accused to be placed on their defence,” the Magistrate ruled.

She directed the matter to be mentioned Thursday to fix the date for the defence hearing.

Itumbi, through his lawyer Katwa Kigen, had urged the court to acquit him on all the three counts that he is facing for lack of evidence but the court dismissed his submissions and put him on his defence.

Elsewhere, the case in which Sarah Wairimu was charged with the murder of her late husband Tob Cohen will be mentioned on Monday.

Wairimu was charged in 2019 alongside businessman Peter Karanja with the murder of her late husband.

Since 2019 when she was charged, the murder trial has never taken off with Wairimu filing several applications seeking to drop the murder charge against her.

Wairimu, who had a rocky marriage with the Dutch businessman, is accused of masterminding his disappearance and murder.

However, she claims the case is corruptly influenced by politicians and other actors who had been eying her matrimonial property once the health of her husband started failing.

Upon her arrest, she says, the police staged a media blitz, publishing details of the case.

She said their actions denigrated her image in the eyes of the public and deprived her of the right to be presumed innocent.
