Supreme Court judges on Thursday put the legal team representing President-elect William Ruto and deputy president-elect Rigahti Gachaua on the spot over the arguments they presented before the court.

Among the issues the court wanted clarity on is the apparent veto power held by IEBC chairman Wafula Chebukati as far as presidential results declaration is concerned.

"What would happen if the chair was to announce the wrong results or was mentally incapacitated or dead, who then would announce the results?" Justice Njoki Ndung'u asked.

She directed the question to former Attorney General Githu Muigai.

The judge also said she was bothered about the role of the other commissioners of the commission who Ruto's legal team said were inconsequential in the announcement of results.

"What do these commissioners actually do because it doesn't come clearly because when one commissioner says he is in charge of ICT, what does it mean?" she posed.

She said she was trying to figure out if the issues at the electoral body are caused by chairman Wafula Chebukati or whether it is a leadership issue.

"What is this problem we are seeing? I would like to understand that and I would like to hear that," Justice Ndung'u said.
