Uncle charged with defiling niece after luring her with cowpeas

A man was on Tuesday charged with defiling his 11-year-old niece after luring her to her brother’s house.

The man identified as PQ (to protect the name of the minor) was charged before Kibera senior principal magistrate Phillip Mutua.

He denied the charges.

The man is accused of defiling the girl, LM, on an unspecified date between July 27 and August 7, 2021, at the Uthiru area in the Dagoretti sub-county within Nairobi county.

He also denied a second count of indecently touching the private parts of the minor contrary to the penal code.

The accused person according to documents submitted in court is said to have visited the family of the minor from Meru for a short while. He had not given prior notice that he would visit.

As a family, he would dine with the victim in her parents' house but often slept in the house belonging to the minor's brother.

The man lured the victim to her brother's house, court documents show, promising to give her cowpeas he had carried from Meru.

He informed the victim that she was to carry the cowpeas to their home as a show of generosity.

When they arrived at the house, the accused person used the opportunity of the missing brother to defile the girl after she felt dizzy.

Moments later, she woke up only to realise that she had been defiled by the accused person and was in pain and was lying beside the accused person.

The court heard that the man warned her not to tell anyone or he would kill her if she disobeyed the order.

The matter was, however, unravelled while at school after her teacher asked all pupils in the class to write down any problem they were experiencing leading to their poor performance.

She informed the teacher of the defilement ordeal who took up the matter and informed her parents.

The girl was taken to Nairobi Women Hospital where a PRC form was filled out.

But the man denied the charges saying they were fabricated.

He was released on a Sh300,000 bond or an alternative cash bail of Sh200,000.

The magistrate directed the matter be mentioned on February 22 so that man can be supplied with witness statements and documentary evidence.
