•They want the court to bar the NPSC from further reducing graduate officers' pay who were recruited into the service in 2013 from Job Group J to Group F.
•In one of the payslips attached in the court documents, the salary before deductions in October was Sh 95,250 but in November the salary was reduced to Sh 51,000.
Two police graduates have moved to court in a bid to quash the decision by the National Police Service Commission to reduce their salaries.
John Kariuki and Meshack Mutukho argue that it was discriminatory for their salaries to be deducted without notice.
Through Lawyer Danstan Omari, the two say they are active members of the police having joined in 2013 after the NPS advertised.
“They joined the services as graduates having joined the service after successful completion of their undergraduate studies in their respective universities,” Omari said.
They want the court to bar the NPSC from further reducing graduate officers' pay who were recruited into the service in 2013 from Job Group J to Group F.
The court compelled the National Police Service Commission and the IG to continue to pay graduates officers in 2013 salaries equivalent to individuals in Job Group J as they used to earn prior to the unilateral decision to reduce their pay.
The two officers who are based at the DCI officers since 2014 claim that they were in Job Group J and have been enjoying Sh 1700 increment per year until when their basic salary was reduced to that of persons in job group F in March 2018.
The NPSC later restored their pay to that group J and paid them all the accrued salary.
“They continued to enjoy their pay equivalent to that of employees in Group J until November this year when they realized that their pay had been reduced back to Job Group F,” the application reads.
According to court records, the changes in payment are affecting all graduate officers who were recruited in the year 2013 and have not been promoted to the ranks of inspector.
In one of the payslips attached in the court documents, the salary before deductions in October was Sh 95,250 but in November the salary was reduced to Sh 51,000.
Omari further argues that there was no communication that the NPSC would reduce his clients pay from Job Group J to Job Group F as the changes were only noted on their payslips.
They want a declaration that the National Police Service Commission and the IG’s unilateral decision to reduce graduate officers recruited in 2013 pay from Job Group J to Job Group F offends the law on fair administrative actions.
They also want the court to quash the decision to reduce graduate officers' pay recruited into the services in 2013 from Job Group J to Job Group F revealed through the November 2021 payslip.
