Two Kenyans withdraw petition to remove Chitembwe from office

Chitembwe is not new to controversy.

Two Kenyans who had filed a petition at the Judicial Service Commission for the removal of Justice Said Chitembwe have withdrawn their case.

John Wangai and Stephen Ooko who filed the petition on November 17 withdrew their petition at the JSC on Friday morning.

They withdrew the case since the matter had not been handled in accordance with rules of natural justice, they said.

They said this is against the law on fair administration action and the fair administrative action act.

“I wish to confirm that we have no complaint against the honorable Justice Said Chitembwe,” the letter read.

“As ardent defenders of the promoting fidelity to the constitution...we have resolved to withdraw the petition."

However, there are two other petitions still pending at the commission that will formally start hearings on December 14 before a panel at JSC.

Chitembwe is not new to controversy.

On July 22, he was dramatically arrested alongside fellow judge Aggrey Muchelule and taken to DCI headquarters to record statements over allegations that they were planning to receive a bribe from an unnamed broker to influence the outcome of a court case.
