Haji opposes proposal to give NCIC powers to prosecute

Director of Public Prosecutions Noordin Haji has opposed plans to give the National Cohesion and Integration Commission the powers to prosecute.

Speaking in Mombasa during a workshop on Thursday, Haji said if one gets the powers the decision still rests with the DPP.

"I don’t understand why individuals want to get prosecution powers, we have been here and we have never asked investigation powers,” he says.

Haji said the NCIC should focus more on empowering its investigation power.

"The constitution is clear that the overall decision rests in the office of the DPP.  They can have them, we dont mind, but they must know that the overall powers lie with the ODPP," he said.

"They have too much to chew, and I don’t know why they are asking for more mandate. My office will oppose the NCIC proposal in Parliament."

The NCIC is seeking to be given more to investigate and prosecute hate mongers.

Consequently, the commission wants the 2019 Act amended to give it teeth deal with rogue politicians who are a threat to the nation’s cohesion.

It wants to be facilitated with more powers in order to prosecute the suspects just as the EACC and ODPP.

The Commission has had three convictions since it was set up in 2008.

Department head Kyalo Mwengi said the commission has over 30 active cases of hate speech and ethnic contempt before court and more than 100 others under investigation.
