DPP denies stalling Kemsa graft case

The Office of the Director of Public Prosecutions has refuted claims that it is holding back investigations on the Kemsa corruption case.

In a statement on Thursday, Deputy DPP Emily Kamau said the office of the DPP is cooperating with the Ethics and Anti-Corruption Commission to exhaustively conclude the case.

Kamau was responding to a news story by Citizen TV which claimed the DPP is yet to return the case file to EACC a year after making a pledge to do so.

EACC forwarded the file to DPP recommending charges against six Kemsa officials.

According to Citizen TV, EACC sources confirmed the files were never returned despite DPPs comments.

Responding to the claims, Kamau said the ODPP had returned the file to the EACC after identifying the area of further investigation.

"The reporting by Citizen TV was inaccurate, malicious and misleading, as it is obvious a lot of work has been going on in the Kemsa probe," Kamau said.

"The ODPP wishes to clarify that the only files retained by the DPP in any investigations are a duplicate file and that the same does not in any way stall ongoing investigations."

in March, a Senate report accused the Board of Kemsa of failing to oversee the operations of the management in the procurement of Covid-19 items.

The report blamed suspended CEO Jonah Manjari for having single-handedly run the show at Kemsa leading to the Sh7.63 billion scandal.

The report by the Senate Health Committee called for the investigation of senior Kemsa officials for their role in the lost funds.

“The committee recommends the ODPP and DCI investigate the CEO, Kemsa and the board of management of Kemsa for contravening the law,” the report reads.
