A Magistrate's court in Garissa has stopped the county’s public service board from assigning any citizen to the office of sub county administrator for Liboi sub county. Senior Resident Magistrate Timothy Ole Tanchu issued the order after a resident of Liboi moved to court arguing that there was no declaration of vacancy of the office of sub county administrator Liboi and no advertisement calling for applications as expected in the County government Act.
The Magistrate said the county board shall not designate one Ali Abdikadir or any other person to the said office pending hearing of the case. Through Lawyer Suleiman Bashir, Abdirahman Ahamed said the purported appointment of Ali by the county secretary was a product of illegality.
“Ali is not a resident of Liboi sub county. The purported appointment was as a result of corruption, nepotism and political cronyism,” said Ahamed. The Magistrate certified the case as urgent and directed the case be heard on June 9.
According to the court documents, the provisions of the Constitution of Kenya 2010 on appointment of public officers were disregarded and procedures for such appointments were not followed at all.
“On May 19 this year, it come to my knowledge through social media platform on facebook of a purported appointment of Ali Abdikadir to the position of sub county administrator for Liboi sub county within Garissa County.”
Ahamed said the purported appointment of Ali was conducted by the County Secretary of Garissa yet there were no interviews conducted and minutes recorded according to the county government act 2012. He says the provisions of section 68 were not adhered to.
