Lawyer ordered to return client's stolen Sh20 million

Magistrate says Benson Kayai will have to give back the money or the case will go to trial •

A court has ordered a lawyer to return Sh20 million stolen from his client.

Benson Kayai was charged with stealing the money from Stephen Muchina on December 2, 2016, in Nairobi.

The charge sheet says Kayai, Muchina's lawyer, stole the money entrusted to him to paying Geoffrey Gitau for the sale of a plot in Ruiru municipality.

Kayai will have to return the money or the case will proceed to full trial.

Kiambu senior principal magistrate Stella Atambo issued the order after Kayai failed to repay the money after two years.

The lawyer had requested the court to grant him more time to settle the matter out of court but failed to comply.

He once again pleaded for time, saying he was looking for funds.

The magistrate will rule today whether to grant his request.

In the same court, a girl narrated how a primary school teacher assaulted a pupil and broke her hand after she failed to attend a remedial lesson on a Saturday.

Sophia Wainaina was charged with assaulting the pupil, now in Form 2 and injuring her on March 29, 2016, at  Kiambu primary school.

She later informed her mother who took her to Kiambu Hospital, where and X-ray showed that her hand had been broken.

They reported to the police and the teacher was arrested and arraigned.

The magistrate adjourned the hearing after the complainant completed her testimony. Other witnesses will testify on May 28.
