Wangamati risks six months in jail for contempt in board row

Bungoma boss Wycliffe Wangamati

could spend six months in jail and pay a Sh300,000 fine for ignoring a court order against interfering with the county public service board.

The board, through its lawyer Calitus Shifoka, filed its case at the Kisumu Labour court on Monday, saying the Governor had disregarded the order issued on December 11, 2017.

Wangamati is to keep off the board's activities until the case is heard and determined.

The board was appointed by former Governor Kenneth Lusaka and its term is yet to expire. Members are Gideon Sirai (chairman),

Janet Manyasi, Peter Masengeli, Stephen Wesonga, Elizabeth wanyonyi and Bonventure Wasikoy.

Resident Moses Lukoye filed a petition at the Bungoma assembly that found the board guilty of corruption, nepotism and abuse office.

Wangamati used the report from the assembly to fire the board.

The team then took court action saying procedures were not followed in the dismissal of members.

The court reinstated them pending the determination of their case.

The board accused Wangamati and his agents of ignoring the court order and making public utterances on a matter before court.

In the application, the members accused the Governor of placing additional locks on the doors of their offices at the Bungoma headquarters.

“The Governor disregarded the orders of this court. We pray he is found guilty of contempt and jailed for six months,” the application reads in part.

The matter will be determined on February 5.

Shifoka said Wangamati was served with the suit papers on Tuesday but

communication director Tim Machi said the Governor had not received the documents.
