Mutava ‘didn’t’ order Pattni’s name hidden

A former assistant executive officer at the Milimani law courts registry yesterday denied that suspended judge Joseph Mutava directed him to conceal businessman, Kamlesh Pattni’s name on the courts legal calendar.

Patrick Thuku told the tribunal Mutava did not direct him on how to describe the parties of a case file on the daily cause list in which Pattni was challenging a decision by the Director of Public Prosecutions to revive his cases.

Thuku, currently in the civil division at the Mombasa law courts, was once attached to the commercial division where he used to help draft the daily cause list in the commercial section.

He said he has never spoken to Mutava about the disputed file. There were allegations Mutava had an interest in the case and initialised Pattni’s name so it would not be known it was his case.

The tribunal heard that Pattnis case had been listed as number 19 on the daily cause list dated September 24, 2012. His name however appeared as initials, which is not the norm. “I do not know why number 19 on the cause list simply stated CC, meaning civil cases. One could not tell the file was lodged by Pattni,” he said.
