Mutunga set to launch new policy on case determination

Chief Justice Willy Mutunga is set to release the revised Sentencing Policy Guideline on Monday after a taskforce completed its review of past procedures.

The task-force gazetted in 2014, was tasked with reviewing past sentencing policies and recommend how to reduce unwarranted disparity while increasing uniformity to promote proportionality in sentencing.

High Court Judge Msagha Mbogholi chaired the task-force whose Secretariat was based at the Judiciary Training Institute (JTI) that offers advisory services to various task-forces.

It was expected to suggest interventions that would include educating and engaging the public and other stakeholders on the sentencing system and its effectiveness.

JTI’s Director, Justice Prof Joel Ngugi said the Judiciary is committed to learning and borrowing from other jurisdictions; strengthening their unique legal innovations while rescuing and mitigating their excesses, failures and mutations.

“While our mantra, goal and action point in this regard is to develop a local jurisprudence which is robust and patriotic; rooted in the socio-political context of Kenyans, we are also quite clear that this growth cannot be inward-looking,” Justice Ngugi said.

He said the Judiciary’s approach is both comparative and multi-interdisciplinary and hence committed to learning from other disciplines outside law.

Mutunga will launch the new guidelines at the Supreme Court in Nairobi at 2pm.
