DPP wants court to lift order on Malili Ranch

THE Director of Public Prosecutions has urged the High Court to lift an order stopping the prosecution of three people over the controversial Malili Ranch sale.

The DPP, through prosecutor Duncan Ondimo, told Justice George Odunga the parties are using the order as a delaying tactic to avoid being prosecuted at a lower court.

Late last year, Odunga issued an order stopping the prosecution of David Ngilai, James Munguti and Leonard Kutua.

The order was not applicable to Machakos Senator Johnstone Muthama, former PS Bitange Ndemo, Ronald Musengi and three others.

Lawyer Okongo Omogeni, acting for former Commissioner of Lands Zablon Mabea, yesterday urged the court to adjourn the case on grounds that most of defence counsel were absent.

The case was adjourned to March 30.
