Nairobi MCAs to have first sitting on September 9, if gazetted

Azimio coalition has 39 compared to Kenya Kwanza's 37.

The third assembly of Nairobi County is expected to hold its first sitting on September 9.

The sitting, according to standing orders, should take place not more than 30 days after the general election.

However, this is subjected to the Governor, who by law is mandated to gazette the sitting.

"The Governor by notice in the Kenya Gazette and the County Gazette, shall appoint the place and date of the first sitting of the new county assembly,” the Nairobi City County Assembly Standing Order 4 (1) says.

By then, the Independent Electoral and Boundaries Commission (IEBC) is supposed to have gazetted the names of elected and nominated members.

The Standing orders also state that there will only be two items in the order paper on the first sitting – the election of the speaker and swearing in of members.

In the sitting, the clerk in this case Edward Gichana will be expected to read the notification of convening the County Assembly as published in the Kenya Gazette.

Gichana will also lay a list of the names of the persons elected as members on the table of the assembly.

“The clerk shall administer oath of office provided for in the First Schedule of the County Governments Act, 2012 to all the members present,” reads the standing orders.

After gazettement of the date of the first sitting by the governor, the clerk will declare the position of the speaker vacant and invite interested individuals to apply for the seat.

In 2017, the MCAs were sworn in on September 6, 2022.

The Nairobi County Assembly is supposed to have 122 MCAs, out of which 85 are elected.

The Raila Odinga led Azimio la Umoja coalition has 39 compared to President-elect William Ruto's Kenya Kwanza with 37, which makes them majority in the house.

However, in terms of parties, Ruto-led United Democratic Alliance (UDA) has the majority at 36 followed by Raila’s ODM with 35.

President Uhuru Kenyatta’s Jubilee Party won five seats, followed by Wiper with four, Chama Cha Kazi won one and independents won two.

IEBC is yet to conduct elections for Kwa Njenga Ward in Embakasi South subcounty, which was postponed by the IEBC.

The second Nairobi County Assembly came to an end on June 13, 2022 after the house proceeded on indefinite recess, to allow for the general election. The sine die recess means there is no specific return date.

During the second county assembly, 23 bills, 326 substantive and procedural motions were passed, while 293 statements were requested.
