MCA seeking to auction properties of popular Meru televangelist over Sh300,000 debt

Televangelist says some of the properties attached to the auctioneer's list don't belong to him

A MCA from Meru is seeking to sell properties belonging to a popular Meru televangelist over an alleged Sh300,000 debt.

The televangelist has since moved to court and filed a certificate of urgency seeking to bar auctioneers from selling his property.

In court documents seen by the Star, the Mbeu ward MCA John Muguna alleges that he lent the respondent the money between February 2, 2023, and March,6,2024 via mobile money transfer.

“Sometimes in the year 2023, I lent the respondent sums of money totalling Sh300,000. I sent the respondent the money via mobile money transfer. The respondent has, however, willfully failed and /or ignored /refused to refund the above sums as well as a demand notice of Sh20,000,” the MCA claimed in a written statement.

Muguna filed the case under small claims court in Meru law courts through his counsel Edwin Kimathi of Mutembei and Kimathi advocates. He had attached documents including mobile money transfer statements. The case is before resident Magistrate Habrovinah Nyamweya.

The two parties made an agreement which was adopted in a court judgment ruled in favour of the claimant on February 21, 2023, where the televangelist was directed to pay Sh50,000 on or before February 28 2024, 100,000 on or before March 30 2024, Sh100,000 on or before April 2024 and Sh100,000 on or before May 2024.

Muguna who is seeking to auction the property said the respondent has only paid Sh50,000 so far, which he says was paid late.

“After he learnt that I had engaged auctioneers and that the auctioneers had obtained a warrant of attachment he rushed to send Sh50,000 which was sent on March 25, 2024, which was not sufficient to offset the 2nd instalment,” Muguna said in a replying affidavit.

The televangelist through his counsel Kirimi Ngentu of Messrs Ngentu &company advocates has filed a certificate of the agency after claimant obtained warrants of attachment and of sale dated May 24, 2024, and thereafter instructed auctioneers who issued a proclamation dated May 28, 2024.

Through his counsel, the televangelist said the auctioneers have exaggerated their fees and are out to enrich themselves.

“Unless the application is heard and orders stopped the applicant will suffer irreparable damage,” his counsel said.

The televangelist wants to pay the remainder of the balance in of decretal sum in equal monthly instalments of Sh30,000, he also wants the cost of the application and of the suit to be borne by the claimant.

However, Muguna through his replying affidavit argues that the televangelist can easily pay his debt because he is the proprietor who reportedly collects weekly colossal sums of money through offerings, donations by well-wishers’ tithes and so on.

Muguna further alleges that the preacher is an astute and successful businessman who owns multi-million properties and he is even putting up a Sh6 billion facility.

However, in his defence, the televangelist said some of the properties attached to the auctioneer's list don't belong to him.
