The police in Kinango Constituency in Kwale County are investigating a case in which a Presiding Officer failed to provide Form 35A.

Kifyonzo primary school polling officer said that she realised the form was missing after she had arrived at the tallying centre.

She was directed to check in all the ballot boxes which were opened before the Returning officer and the chief agents but nothing was found.

"I have a PO who lost the forms which we were supposed to be used in tallying the results, an issue which is beyond me and now police have to involved," Retuning officer Joseph Mwafondo said.

Mwafondo said that they will solve the issue amicably.

"The legal position here is to use the total number of registered voters at Kifyonzo polling station to decide how we will distribute the votes among the 10 MPs depending on how they have performed on the other 236 polling stations," he said.

"If anyone will feel like he or she is not satisfied with the process, they are allowed to take the matter in court," he said.

Kinango Tallying centre officer Fredrick Ombaka said that they still do not know at what point did the confusion happen but DCI officers are investigating the matter.

"We are in communication with the IEBC for consultation but the DCI officers are the ones who are supposed to carry out the investigations," he said.

The polling station has 453 voters.
