EACC recommends prosecution in 721 cases in last five years

In a report, the commission also recommended administrative action for 70 cases

The Ethics and Anti-Corruption Commission has forwarded 721 investigations to the Director of Public Prosecutions with recommendations for prosecution in the last five years, a report shows.

The report submitted to the Constitutional Implementation Oversight Committee of the National Assembly said the commission recommended administrative action for 70 cases during the same period.

“The commission has finalised prosecution of 251 corruption and economic crime cases in court, resulting in 141 convictions, 70 acquittals and 40 withdrawals,” the report added.

The report outlines the achievements of the EACC on its constitutional and statutory mandate, in the last five years from 2018-2023.

It also highlights the key impediments and challenges, and proposed interventions.

EACC noted that it has conducted and finalised systems reviews and corruption risk assessments in 65 public entities; issued advisories to 686 Ministries Departments and Agencies under the Performance Contracting framework.

The commission added that it has issued 1,106 advisories on ethics and integrity, processed 48,383 requests for integrity verifications, issued 276 cautions, processed 1,342 applications for opening and operating bank accounts outside Kenya and developed, reviewed or approved 100 codes of conduct.

It noted that it has also conducted continuous training, education and awareness programmes under the National Integrity Academy.

The commission called for the strengthening of inter-agency cooperation to facilitate sharing of information.

It further appealed for strengthening of legal, institutional and policy frameworks to provide an effective framework to prevent, combat and deter corruption.

EACC is empowered to cooperate and collaborate with state agencies, foreign governments or international organizations in the prevention and investigation of corruption.

The commission also derives its statutory mandate from several other statutes namely, the Anti-Corruption and Economic Crimes Act of 2003, the Leadership and Integrity Act, 2012, the Public Officer Ethics Act, 2003 and the Bribery Act, 2016 among others.
