AGOK faults state over ‘blanket’ ban on gambling advertisements

BCLB suspended all gambling advertisements and testimonials across all media platforms for a period of 30 days.

The Association of Gaming Operators-Kenya (AGOK) has criticised the government for a “blanket” ban on all gambling advertisements.

The betting regulator, Betting Control and Licensing Board (BCLB), in a notice dated April 29, suspended all gambling advertisements and testimonials across all media platforms for a period of 30 days.

While justifying the suspension, BCLB said that the government had noted “with grave concern” the proliferation of gambling activities across the country.

“Some gambling promoters are increasingly mischaracterizing gambling as a legitimate investment opportunity and a shortcut to wealth creation. The erroneous depiction occasions adverse socioeconomic consequences, with devastating effects on individuals, families, and the broader community,” the notice signed by BCLB Chairperson Jane Mwikali.

But in a rejoinder, AGOK now says that BCLB erred in its move and did not consider the licensed tax-compliant firms.

“Blanket advertising bans inadvertently penalize compliant tax-paying firms that have invested significantly in responsible gaming, while offshore and illegal operators continue to operate,” a statement from the AGOK Board, dated April 30, reads in part.

AGOK is calling for a structured dialogue with the BCLB, the multi-agency enforcement team and all other stakeholders in a bid to formulate balanced advertising guidelines that promote responsible gaming without undermining lawful business operations.

The association has also supported the move to develop clear, transparent advertising standards co-created with industry, media, and regulatory agencies.

“AGOK is actively working on amplifying its nationwide responsible gaming campaign in collaboration with BCLB, psychologists and media partners,” AGOK added.

“We request collaboration in identifying and eliminating Illegal and offshore platforms and gambling dens that target Kenyan consumers.”

AGOK has further reiterated its commitment to responsible gaming, fair taxation, and constructive engagement with government and the public.

“We call upon all stakeholders to work together towards a safer, more transparent and ethical gaming environment in Kenya.”

A Multi-Agency Enforcement Team has been established to formulate strategic interventions, policy recommendations, and enforcement mechanisms to advance responsible gambling practices across the country.
