Businessman skips court

A Nairobi businessman yesterday failed to appear in court for the mention of his conspiracy to kill case. Hiten Kumar through his lawyer Sam Nyaberi told the court that he was not feeling well and was on bed rest on doctor’s orders. Prosecutor Justus Amaana, however, opposed his application telling the court that defense was playing mischief and needed to verify the claims that Kumar is ill.

He told the court that since the case began, the accused has been at large and the investigating officer was not informed when when he took plea. Last month, Kumar asked the High Court to stop the police from arresting him after a warrant was issued against him and his face printed in the local dailies.

The High Court stopped police from arresting him but ordered him to appear in court on September 4 to plead to the charges. Kumar went to court a day earlier than scheduled. Amaana said there is foul play by the defense because the accused has not reported to the police station to have his finger prints taken and other formalities. The case will be mentioned on September 24 for further orders.
