Embakasi East MP Babu Owino now wants a suspect in the murder of business woman Monica Kimani released.
Babu on Friday said it is unfair for Joseph Irungu, alias Jowi, to be in jail for an extended period without being given the option of posting bail.
The legislator on his Facebook account said, "Jowie should be released on cash bail or bond by the Judiciary and if found guilty be jailed."
"Is it because Jowie is poor that’s why he is being frustrated...?" he added.
Jowi was arrested last year September after he was linked to the murder of Kimani.
Since then, he has been held at the Kamiti Maximum prison after he was denied bail.
He has made two attempts to be released either on cash bail or bond but the courts turned him down for what they termed as premature application and lack of merit.
But Babu Owino said, "When Governor Obado was alleged to have murdered, he was given a cash bail/bond term. Sarah Wairimu alleged to have murdered Cohen was released on Cash bail/bond. Marxism’s of law is that equity is equality".
The prosecution has lined up 33 witnesses to testify against Irungu and journalist Jacque Maribe, who was his then fiance in the murder.
Assistant director of Public Prosecutions Catherine Mwaniki said four of the 33 are protected while five are expert witnesses.
Appearing before Justice John Wakiaga on Tuesday, Mwaniki said the prosecution has secured concrete evidence including photographs and digital records to prove their case.
The prosecution also also objected to the release of Irungu on grounds he would interfere with the investigations.
