Kinoti will be prosecuted if found guilty of any crimes - Haji

Director of Public Prosecutions Noordin Haji said he would prosecute former DCI boss George Kinoti if he is found guilty of any crimes.

Haji who was speaking at a local media station on Sunday night acknowledged that Kinoti was his colleague, but he will not take advantage of the situation. 

"If somebody broke the law, they would have to face the law," Haji declared. 

The DPP added that if he goes against the law, he will also face the consequences.

"Even if it is him (Kinoti), even if it is me. You have to face the law. There are no two ways about it. Because if we let this go then it will become a norm in Kenya," he added.

This comes after a senior DCI officer came out claiming Kinoti directed him to recommend charging Deputy President Rigathi Gachagua in the Sh7.3 billion graft case.

Kuriah Obadiah, who was in charge of the team investigating the allegations, said DCI began digging into the matter after receiving a letter dated April 15, 2020, from the Financial Reporting Center.

The letter brought about allegations of embezzlement of funds at the National Irrigation Board and other institutions.

In a sworn affidavit from October 15, the Superintendent added that he was directed to conduct a thorough investigation.

However, he added that they were given "very strict and fixed timelines to come up with findings promptly which made it difficult to conduct thorough and comprehensive investigations into the allegations".

"While investigations were still in progress, the director of DCI, George Kinoti, directed us to make recommendations that will enable the accused persons to face charges," he said.

He added: "Based on immense pressure from my director, Kinoti, my team made the recommendations. The accused persons were charged, and investigations could not continue as contemplated for various reasons."

Kuria said some crucial areas of investigation that would have determined whether the accused was guilty or not were not covered.  

Subsequently, he made an application to have the case withdrawn to allow time to fully investigate the allegations.
