A Labour court has said it has the jurisdiction to hear a case filed by LSK challenging the establishment of the Chief Administrative Secretary positions.
Employment and Labour judge Monica Mbaru dismissed an objection filed by the Attorney General and the Public Service Commission that was questioning her jurisdiction over the matter.
Mbaru said such matters cannot be removed from her court as they are directly related to employment and labour relations.
"The process of the establishment of the office of CAS is challenged and the petitioner (LSK) is before the right forum to argue its case," she said.
The Law Society of Kenya filed the petition on September 7 seeking implementation of the process towards establishment of the Chief Administrative Secretary.
LSK says the lack of clarity on the intended office of the CAS denies the public the opportunity to make comments on the possibility of the duplicity of roles between the principal secretary and the CAS.
LSK says any duplicity would lead to the wastage of public funds in wages and attendant expenses.
The court has since suspended the implementation of the process towards the establishment of the office of Chief Administrative Secretary in the public service.
