Tribunal refuses to allow Azimio in Masit hearing

Muchelule said Azimio has not given reasons how they will be prejudiced if Masit is removed or not

The Tribunal for the removal of IEBC commissioner Irene Masit has this morning declined to allow the Azimio alliance to be an interested party in the matter.

Justice Aggrey Muchelule has said Azimio has not given reasons how they will be prejudiced if Masit is removed or not by the tribunal.

Azimio had argued that they have been adversely mentioned by different witnesses who have appeared before the tribunal.

Through lawyer Danstan Omari Azimio had filed an application to be enjoined in the matter as interested party.

In an affidavit sworn by Oduor Ong’wen the party wanted to defend themselves against the allegations levelled against them. 

Irene Masit’s lawyer Donald Kipkorir has also raised concern about some members of the tribunal being close to President William Ruto’s allies and even represented him at the Supreme court.

Kipkorir says the vice chair Caroline Kimende represented the president and the joint secretary Kibet Emmanuel is a business partner to a current CS.

He also claims that the lead counsel Peter Munge works in a law firm of a current UDA central MP.

Kipkorir is questioning if these members will be fair to his client since they were appointed by the President.

He says he does not want them to recuse themselves but to search their conscious and be fair to Masit.
