The Kimwarer and Arror graft case against former Treasury CS Henry Rotich will now be heard by another magistrate.

This is because the trial magistrate Chief Magistrate Lawrence Mugambi was last week promoted to a judge.

“Considering it’s a fairly new hearing I think it will be prudent to take it to another magistrate,” he said

He said if it was the last witness, he could have proceeded to conclude the matter and written a judgement.

“The trial court has been elevated considering two witnesses have testified it’s not convenient for the court to hear the case as there are many other witnesses who are yet to testify,” Mugambi said

The case will be mentioned on December 16 for further directions as to the hearing of this case.

Only two witnesses have so far testified in the matter and the second witness is yet to be cross-examined.
