Kimilili MP Didmus Barasa is relieved after Kakamega High Court lifted orders barring him from stepping foot in Bungoma.
Justice PJ Otieno allowed the application that was filed by Barasa’s lawyers asking for a review of the stiff terms.
This was part of the bail terms granted to Barasa after he was charged with the murder of his rival's aide in August.
“The application is allowed to the extent that the terms of bond that the accused never visit Kimilili constituency and the larger Bungoma are set aside,” the court ruled.
In his application, Barasa said the order had barred him from visiting any place within Bungoma, and that would prevent him from carrying out his mandate as Kimilili MP.
Through lawyer Danstan Omari, Barasa said opponent Bryan Khaemba has filed an election petition at the Bungoma law court and it requires him to be present, which he couldn’t do with the said order.
He also told the court that he needed to go to Bungoma to look for witnesses to help him in his defence against the election petition.
“Applicant (Barasa) is cut between defending himself and the will of the people, as the election petition challenging his win seeks to subvert the popular will of the people and respect the orders of this court made on August 24,” reads court papers.
Barasa said he would not interfere with witnesses because his home is in a different area from the alleged crime scene in Chebwukwabi.
He pleaded not guilty to the murder of Brian Olunga, Khaemba’s aide.
Olunga was killed on Election Day, allegedly during an altercation between Barasa and Khaemba at a polling station
