EACC wants new leaders to commit to integrity as they take oath of office

The commission suggests they sign leadership and integrity code before assuming office

The anti-graft agency wants elected and nominated leaders in the counties to sign and commit to leadership and integrity code at the time of taking oath.

Ethics and Anti-Corruption Commission (EACC) said governors, deputy governors and elected and nominated members of county assemblies to sign the documents before assuming office “in the interest of efficiency and effectiveness.”

The law requires that elected or appointed state officers sign and commit to the relevant leadership and integrity codes either at the time of taking an oath or within seven days of assuming office.

The oath of office is administered by the judicial officers appointed for the purpose by the Chief Justice.

“The commission kindly requests that the Committee on the Assumption of the Office of the Governor in your respective counties incorporates the signing and commitment to leadership and integrity codes by elected governor, deputy governor at the time of taking oath of office,” EACC said in a letter to counties secretaries, who are the chairpersons of the committees on the Assumption of the Office of Governors.

EACC said it will ensure its commissioners are available to provide technical support “that may be required in the process including ensuring that the state officers sign and commit to the appropriate codes through the respective forms.”

The commission said it will assign a representative to every region where the administration of oath will be taking place.

“For this purpose, our regional managers will be liaising with your respective committees for planning and logistics,” the letter by EACC boss Twalib Mbarak added.

In another letter to county assembly clerks, EACC also requested that signing and commitment to integrity code be incorporated in administration of oath.

“The purpose of this letter is to communicate this request and seek your concurrence and support in the exercise.”

Under Section 40 of the LIA as read with Regulation 34(2) of the Leadership and Integrity Regulations, 2015, each newly elected or appointed state officer is required at the time of taking oath of office or within seven days of assuming office, sign and commit to the specific leadership and integrity code prescribed by the public entity to which the officer has been elected or appointed.

“Where a public entity has not developed the specific code envisaged under Section 40, Section 38 of the Act, as read with the Regulation 34(1), requires that a state officer elected or appointed to that public entity shall sign and commit to the General Leadership and Integrity Code.
