IEBC Chair Wafula Chebukati has said they will heed the court ruling on the use of the KIEMS kit as the primary method of voter identification.

“The commission shall stand guided and we have directed our staff who had been trained to follow procedures as stated by the court,” he said.

“They will have a physical register and only use it when the KIEMS kit fails within those polling stations.”

Chebukati said the Voter register in Kiems kit is the same as the physical register.

"If you are not in the kit , it means you are not in the physical register. We will identify you using your ID. If the Kiems kit fails, we will try another one but if they fail, we will now resort to manual register," he said.

He said the registers will be available at the stations but they will be sealed but used on need basis.

The Court of Appeal on Monday suspended a High Court decision that directed the Independent Electoral and Boundaries Commission to use the manual register.

The appellate court said, "UDA has made a case for the grant of the orders of a stay of the entire judgment delivered on August 4, 2022, in the Nairobi High Court in the constitutional petition E306 of 2022 pending the hearing and determination of the intended appeal."

The ruling comes after the party filed an application through lawyer Elias Mutuma challenging last's week decision.
