Sonko, Waititu impeachment was state-sponsored - Cheruiyot

The County Governments Act mandates the Senate to receive impeachment motions.

Kericho County senator Aaron Cheruiyot has claimed the impeachment of former governors Ferdinand Waititu (Kiambu) and Mike Sonko (Nairobi) was state-sponsored.

During Tuesday morning's discussion at KTN News, Cheruiyot said the impeachment of the two former governors was not done according to the law.

"If you are a governor and you are impeached, you have the chance to stay out but you must be given chance to defend yourself at the court of law," Cheruiyot said.

He added The County Governments Act mandates the Senate to receive impeachment motions on governors, hear the charges and vote on whether to oust them or not.

Sonko was impeached in December 2020 after the majority of the senators voted to uphold four charges levelled against him by city MCAs.

The former Nairobi governor was accused of gross violation of the constitution and any other law, abuse of office, gross misconduct and crimes under national law.

Sonko, however, went to court to appeal for his impeachment process on the basis that no verification was done by members of the assembly supporting the motion for his removal. 

The high court said they could not fault the county assembly and the senate for his removal from office.

Waititu, on the other hand, was impeached for lack of accountability in the management of county resources, disregarding the County Assembly as an arm of the County.

Other charges included awarding Sh.2.1 billion towards road tarmacking contacts against the approval of Sh 1.4 billion and criminal offences. 

He faces another count together with his wife and a company they co-founded -Bienvenue Delta hotel.

Despite the denunciation of  Sonko in 2020, he was finally cleared on Monday, to vie for Mombasa gubernatorial race, he's been facing court charges trying to bar him from running for any government office.
