Police officer to be arraigned over civilian murder — IPOA

Omwacha was allegedly assaulted by the police on February 19, 2019.

A police officer is expected to appear before Kisii High Court on Tuesday to face a murder charge contrary to Section 203 as read with Section 204 of the Penal Code.

This follows an extensive investigation by the Independent Policing Oversight Authority into the incident in which Charles Onditi Omwacha was allegedly assaulted by the police on  February 19, 2019.

He was being treated for injuries he allegedly sustained after an encounter with the said police at Club 23 in Ramasha Trading Centre before he died on  March 1, 2019.

In May, eight police officers were arraigned for various offences, including murder and assault in connection to the death of Charles and other victims.

The directive was given on May 24, 2022.

In Kisii, the Office of Director of Public Prosecutions (ODPP) had directed the County Police Commander to present Police Constable Vincent Cheruiyot Langat within fourteen (14) days, at the local law court, where he was facing a murder charge.

All the cases were registered in court on orders of the ODPP, which independently reviewed the investigation files and concurred with IPOA’s findings and recommendations.
