Tales of defiled minors pushed me to tears, cop tells court

One of the girls had to undergo an operation after she developed complications

A Mombasa-based police officer on Thursday told the court that he shed tears when two minors narrated to him how they were molested by a neighbour.

Samson Kahindi, a police officer based at Mikindani police station in Mombasa, gave a blow-by-blow account of how two girls were raped.

Micheal Mutua alias Tomato alias Kamangu, has been charged with committing multiple accounts of rape to the two minors.

According to court documents, Mutua defiled a child aged 12 years on September 14 and 20, 2020 at around 12.30pm.

He is also charged with defiling another 11-year-old girl.

The two offences were allegedly committed in Kwa Matei, Jomvu subcounty.

Kahindi, the investigating officer in the case, told the court he was told by the OCS to handle the case on September 21, 2020.

He called the parents of the children who were defiled and interrogated them.

The officer said he cried while listening to the children narrate their ordeal in the hands of Mutua.

"The children told me how the rape happened and I cried upon hearing what they went through because it was a beastly act," he said.

Kahindi said together with the parents of the two children, they took the children to Port Reitz Hospital for medical assessment and help. 

After the medical check-up, Kahindi told the court, "It was confirmed by the doctor that the children had been defiled and sodomised.”

They were given a P3 form and a Post Rape Care (PRC) form to proceed with the case. 

Kahindi also talked to other witnesses before arresting the accused, who at the time had fled.

After dodging the police for about three months, the accused was arrested on the night of January 20, 2021, following a tip-off from one of the victims' mothers.

He was arrested in his house.  

As time went by, the damage done by the accused on one of the girls worsened, Kahindi said.

"After several months, I was informed that one of the children who had been defiled had developed more serious injuries. The complications affected her so badly she was taken to Bomu Hospital where she was admitted," he told the court.

Doctors performed an operation on her to repair her damaged anus.

This operation necessitated more investigations, and Kahindi went to Bomu Hospital and talked with the doctor who had operated on the child, in a bid to gather more evidence.

The officer told the court that before the police took over the case, the parents of the two children had sought the help of the village elders to try and resolve the case.

The elders called in the police.

The hearing continues before Mombasa chief magistrate Martha Mutuku.
