Businesswoman Wambui Sh2.5bn tax evasion case to proceed on June 6

The prosecution will be calling eight witnesses to testify

The anti-corruption court on Tuesday directed prosecution and defence in Sh2.5 billion tax evasion case against businesswoman Mary Wambui to prepare documents to be used in the case.

When the case came up for mention before chief magistrate Felix Kombo, the parties asked for more time to agree on which documents to be used.

This is after the parties said there are a bundle of documents which need to be sorted out first before the case proceeds for hearing on June 6.

The prosecution will be calling eight witnesses to testify against Wambui. 

The court heard the prosecution's first witness will take about 72 hours over three consecutive days.

Purma Holdings Limited and its directors Mary Wambui Mungai and Purity Mungai are accused of knowingly and unlawfully omitting Sh2.2 billion from the company’s income tax returns.

According to the prosecution the money should have been included in the income tax returns submitted to the commissioner for the 2014 income.

They have since denied the charges and are out of on a cash bail of Sh50 million. Wambui has deposited the cash bail from the loan account of a hotel she is constructing in Nairobi to secure their release.

In March, the accused asked the court to allow them to substitute the cash bail with land in Juja and Nyandarua. 

Wambui wanted the exchange saying she was in dire need to facilitate ongoing construction work. 

She had told the court that unless the application is heard and determined, there is real danger the construction of Glee, which was being undertaken with funds in the Glee Hotel loan account, may stall leading to grave financial implications to the company.
