The High Court has declined to postpone the upcoming General Election slated for August 9, saying the date is constitutional.
Justice Anthony Mrima said General Election should be held simultaneously and that it is not a negotiable matter.
"August 9 is constitutionally the second Tuesday of the General Election of the fifth year. The Constitution is clear on the election date. The Constitution can't subvert itself," he said.
The case was filed by former nominated Senator Paul Njoroge.
He argued the commission was not properly constituted when the declaration for the next General Election date was made.
This argument was dismissed by the court since the commission now has a CEO.
He also argued that the term for President Uhuru Kenyatta and DP William Ruto would lapse in November because the last elections were held on October 26, 2017.
However, the Constitution requires that a General Election be held on the second Tuesday in August every fifth year.
This means that the next General Election is supposed to happen on August 9, 2022.
