Moses Kuria threatens to expose IEBC over 2017 elections

Gatundu South MP Moses Kuria now wants the IEBC to open servers as ordered by the Supreme Court of Kenya in 2017.

Speaking after appearing before the IEBC over his vote-rigging remarks case, Kuria appeared to suggest that he will reveal a lot about the IEBC with regard to the 2017 polls.

The MP said he will move to court to challenge IEBC's decision to hear his vote-rigging remarks case even after he pleaded otherwise.

Kuria threatened to expose the IEBC as he move to court to challenge the IEBC's decision to hear the case even after he argued that they had no jurisdiction over it.

"I am not the one who impugned the 2017 general election, it is the Supreme Court," Kuria said.

" I think it is a wonderful opportunity for the Kenyans to be able to audit the server so that we do not put this country into another crisis".

He said IEBC ought to have opened the servers as directed after the 2017 polls.

"I intend to call the supreme court as the witness because until now, the orders to open the servers were not complied with," Kuria said.

He said it was an opportunity for Kenyans to know what transpired during the 2017 polls to avoid political chaos.

Kuria’s legal team led by Ndegwa Wahome had objected to the charges challenging the Committee's jurisdiction on the matter.

"It is prudent that this committee downs its tools until the court pronounces itself on the jurisdiction issue," Ndegwa said.

"You cannot be a prosecutor, complainant and a judge."

IEBC chairman Wafula Chebukati in a ruling on Wednesday said the matter was legally before the Committee, dismissing preliminary objections raised by the defence team.

"Electoral Code of Conduct Enforcement Committee has jurisdiction and is legally ceased of the matters," Chebukati ruled.

Chebukati set April 7, as the date for hearing Kuria's case.
