A woman who threatened to kill city lawyer Elvis Abenga in 2019 has been jailed for six years.
Patricia Kinyua was convicted by Kibera senior principal magistrate Esther Boke for threats against lawyer Elvis Abenga.
She was found guilty of sending a spine-chilling text message and threatening the lawyer, verbally, in an open court.
According to the charge sheet, Kinyua committed the offence on diverse dates between October 8, 2019, and January 24, 2020, within Nairobi county.
The court heard during the trial that the lawyer had written a letter to her on behalf of her ex-boyfriend concerning the pregnancy she was carrying when she decided to respond by threatening him.
He told the court that he received a message on WhatsApp from Kinyua who told him he was going to regret interfering with the life of her boyfriend.
“I received a message from the accused person through my WhatsApp. She told me that I was going to regret interfering in Robert’s pregnancy matter. He was my client and her boyfriend. The accused person sent me the messages repeatedly,” he told the court.
He told the court that he reported the matter to Capitol Hill police station but that did not stop Kinyua from sending him more messages.
He told the court that one day, the accused person sent him an audio clip in which she vowed to kill him.
“I was in my office when she sent me an audio in Kiswahili 'nitakuua na mwili yako isipatikane' loosely translating to 'I will kill you and your body will never be found',” he added.
He said immediately he received the message, he left his office and went to Kisii as he feared for his life.
The accused person denied the charges.
“I knew the lawyer through the letter he sent me on behalf of my ex-boyfriend who said that the pregnancy I was carrying wasn’t his. He was a close friend of my boyfriend,” she said.
Prosecutor Nancy Kerubo called several witnesses, including the investigation officer.
While convicting her, Boke said the prosecution had proved the case against the accused.
