Nairobi Deputy Governor Ann Kananu wants court to stop her arrest over Sh2.1 billion tax arrears demanded by the Kenya Revenue Authority from the county government.
Kananu, the county government of Nairobi, Finance executive Allan Igambi, debt management deputy director David Wambugu and county treasury head Martha Wambugu say their arrest would be an abuse of the criminal justice process as it is intended to embarrass them. They say the issue is being negotiated by the county and KRA.
Kananu and the three officials claim they are separate and distinct legal entities from the Nairobi government, but the Directorate of Criminal Investigations KRA unit says it has reasons to believe the three are either connected with the offence or have useful information that may aid investigations.
Through lawyer Thomas Letangule, Kananu says the tax arrears demanded by KRA are amounts accumulated since 2011 when she was not in office. From the ongoing negotiations, the county on July 7 committed to making a monthly deposit of Sh250 million.
So far, a deposit of Sh1.3 billion has been made. The county says it intends to honour the remaining debt by making payments in instalments.
According to court documents, Kananu and the three officials were served with a notice dated October 27 and summoned to appear at the DCI's KRA unit the following day.
But the respondents say the intended process by KRA and the DCI is unfair. They seek an order stopping any further proceedings pending the hearing and determination of the application lodged in court. Also sought is an order for anticipatory bail pending arrest or charging in court.
“The intended actions have been actuated by malice, ill will and ulterior motives. The DCI and KRA are using the criminal process as a tool to settle scores and demonstrate muscle,” they say.
