A suspect in the murder of Dutchman Herman Rouwenhorst and his guard has sought a plea bargain with the prosecution.
Mary Nekesa, the girlfriend of Timothy Omondi, has allegedly agreed to cooperate with the prosecution to solve the murder mystery.
In return, the suspect is expected to get a reduced sentence.
Nekesa and Omondi were arrested on July 26 on suspicion of links to the murder of Rouwenhorst and guard Evans Bokoro at his Rocco apartment in Shanzu area, Mombasa county.
Prosecution counsel Valerie Ongeti has informed the High Court of their intention to turn Nekesa into their witness.
Ongeti applied for Nekesa to be remanded at the Malindi GK prison as they finalised the deal.
The prosecutor has also applied for the court to direct the deputy registrar to appoint separate pro-bono advocates for the suspects.
Ongeti also sought orders to have the couple undergo a mental assessment before they could take a plea.
Judge Erick Ogola directed Nekesa to be remanded in Malindi while Omondi at Shimo la Tewa prison.
The judge also directed the suspects to be taken to Coast General Hospital where they will undergo mental assessment.
“The suspects will appear before the court on September 16 where they will take a plea after receiving the mental assessment report,” Ogola said. The duo is expected to be charged with two counts of murder.
Police investigations revealed that Omondi removed the murder weapon from the scene. Bullets were also recovered during their arrest at Florida village in Kiembeni.
The police also recovered clothes that contained bloodstains. They have been forwarded to the government laboratory for tests.
Investigation officer Reuben Mwaniki said the two were arrested at their newly constructed mansion on a piece of land acquired recently.
Mwaniki told the court they were investigating whether the funds used in buying the land were the same funds stolen from Rouwenhorst.
Mwaniki said an unknown amount of cash in Kenyan shillings and foreign currencies were stolen from a safe in the house.
The detective said the new house also had new appliances such as a TV set and a refrigerator.
Last month, Rouwenhorst's wife Riziki Cherono was charged with his murder and that of Bokoro.
She pleaded not guilty but the court has yet to release her on bond.
