UFAA audit tender discriminatory, say accountants

Decision to award 12 marks to previous contractors put a barrier for their members

An audit tender by the Unclaimed Financial Assets Authority will lock out anyone who has not offered services to the organisation, an accountant's lobby has said. 

The Institute of Certified Public Accountants of Kenya has challenged the tender in court, saying the evaluation criteria is discriminatory. 

They say nearly all members of ICPAK offering audit services but yet to be hired by UFAA will lose out. 

UFAA on November 17 last year put up a tender notice inviting sealed tenders from interested auditors for prequalification. 

The terms of reference, which included the objectives and scope of work, specified 30 assignments for the successful bidders. A bidder could quote for a maximum of three assignments only.

Through lawyer George Ogembo, ICPAK says the decision by UFAA to award 12 marks to previous contractors put a barrier for their members. 

“The selective appraisal is illegal, unfair and unreasonable for failing to promote competitive, fair and open procurement process,” it says.  

 ICPAK wants the court to compel UFAA to readvertise the tender and conform with the law.

 They also want UFAA to halt the processing of bids and tender documents received from ICPAK.
