Court adjourns graft case after accused comes with infant

A graft case was adjourned on Tuesday because one of the accused persons came with a newborn to court.

Agnes Njeri Muthoni, who is one of the accused in Embakasi North MP James Gakuya's graft case, came to court with her one-month-old baby.

Trial magistrate Elizabeth Juma said she was moved when she saw the child because with the current third wave of Covid-19 a baby should not be in an open court.

"A one-month-old ought not to leave the comfort of the house during these times of Covid-19," Juma said.

She ordered Muthoni to leave the child at home on the next hearing date, advising her to express the milk and leave the baby with someone.

However, she was cautioned not to try to use the baby to delay the matter in the name of not having someone to look after the child.

Muthoni had told the court she does not have anyone to tend to the baby in her absence.

Earlier, lawyer Danstan Omari had asked the court for an adjournment, saying one the defense lawyers had lost his father-in-law who was being buried.

The prosecution objected to the adjournment, asking the court to direct the matter to proceed as had been scheduled for Wednesday, Thursday and Friday in the court diary.

The court noted there was no documentation brought to court to support the application for adjournment by the defense.
