Supreme Court upholds Nyagarama's victory

The Supreme Court on Wednesday upheld the election of Nyamira Governor John Nyagarama.

Justice Njoki Ndung'u said the petitioner Walter Nyambati had not properly invoked the jurisdiction of the court.

Nyambati of Jubilee was contesting Nyagarama's win in the 2017 election on the ODM ticket.

Osebe went to the apex court after he being dissatisfied with the rulings of the High Court in Nyamira and the Court of Appeal in Kisumu.

At the same time, the apex court is

expected

to determine the fate of Embu Governor Martin Wambora.

His victory is being challenged by former Embu Senator Lenny Kivuti.

Kivuti too was dissatisfied with the Court of Appeal's judgment that overturned the High Court's decision nullifying Wambora's election.

He wants the Supreme Court to invalidate Wambora’s win and order a fresh election.

Justices William Ouko, Daniel Musinga, and Fatuma Sichale ruled in Wambora's favour

The three judges said Kivuti, who challenged the governor’s victory in the August 2017 election, did not prove his case.

The said Kivuti did not discharge the legal burden of proof to the required standards to show that there were alleged irregularities during the election.
