TSC, Knut to know outcome of mediation on January 31

The Employment and Labour Relations Court has directed the conciliator in the mediation talks between Knut and TSC to file a report in court by January 31.

In the hearing on Thursday before Justice Maureen Onyango, the Kenya National Union of Teachers accused the Teachers Service Commission of disobeying court orders by transferring teachers.

However, the TSC accused the union of presenting a list of teachers who had been transferred earlier.

On January 2, Justice Byram Ongaya blocked the transfer of Knut branch officials and allowed the affected teachers to seek review without being victimised.

“Pending an agreement on the transfer of union officials beyond the geographic limits of the branch they are elected to serve, the decision to transfer such officials is stayed and as such, transfer beyond the branch territory is now set aside,” Ongaya said in a ruling.

The court also directed the TSC not to transfer Knut officials to different schools.

Teachers are against transfers and performance contracting.

They also want promotions in line with their CBA.

Onyango told the TSC and the teachers to negotiate in good faith.
