Kidero hits out at Judiciary over delay of his case

Former Nairobi Governor Evans Kidero has taken issue with the manner in which one of his cases at the anti-corruption high court is being delayed.

Kidero in 2018 sued the Ethics and Anti-corruption commission seeking to have it barred from searching and seizing his properties. The matter is still ongoing.

"The Judiciary is delaying my cases unnecessarily. Justice delayed is justice denied," said Kidero.

The case had been listed for hearing before Justice Mumbi Ngugi but since she is away, the matter was placed before another judge for directions.

According to the schedule of court cases that were to be heard today, it was indicated that Mumbi will not be sitting from November 4 to 22 as she is involved in a bench conferencing and writing judgments for four different petitions.

On October 24, the same case was also meant to come for hearing but didn't proceed because Mumbi was on leave.

The schedule of court cases is normally referred to as a cause list which is always posted on the Kenya Law report online page.

The notice on the Kenya Law report indicates that all matters to be heard before her during the mentioned dates will be mentioned before Justice john Onyiego for directions.

Lawyer Nelson Havi, who is representing Kidero in the matter, also took to Twitter over the issue and said it is 'genuinely alarming'

"On 14.9.2019, Judge is on leave in September until October; on 2.10.2019, she is on leave until October; on 24.10. 2019, she is on leave until November; and on 4.11.2019, she won’t sit until 22.11.2019 as she is writing Judgments. CJ maraga this is genuinely alarming," read his tweet.
