Education CS George Magoha and Attorney General Paul Kihara risk being charged with contempt in a case filed by a resident seeking to stop appointment of the new Bomet University College principal.

The two are accused of defying a court order and installing Ann Nangulu to replace outgoing principal Thomas Cheruiyot.

In the order issued by Justice J.N Abuodha of the Employment and Labour Relations court in Eldoret, the judge stopped implementation of the decision of the university council on appointment of the principal and two deputy principals.

The court also restrained the three from carrying out their duties as appointed pending the hearing and determination of the petition.

In the changes made by Magoha, George Otieno is set to take over as deputy principal in charge of academic and student affairs while Loyce Maru was to assume the position of deputy principal for administration and finance.

In the ruling issued on October 4, the judge set he case for hearing in 30 days.

The Public Service Commission is listed as the third respondent in the case filed by Julius Sing'oei.

Lawyer Wambua Kigamwa representing the petitioner said he would be filing a case to have the two charged with contempt of court for disobeying court orders.

He claims he was privy to information that the new principal had already assumed office and even went ahead to chair meetings at the university.

“We are only waiting for a go-ahead from our client before suing the two. We have been made to understand that the two are even in office when the court has barred them,” he said.
