DPP warned over delay of PCEA officials theft case

Court told the DPP to 'put his house in order' to allow the case to continue, prosecutor given until July 2

The Director of Public Prosecutions was yesterday warned to stop delaying a case in which a former Presbyterian Church of East Africa moderator and two others are accused of stealing Sh50.9 million.

Kiambu senior principal magistrate Stella Atambo said the prosecution was deliberately delaying the case.

David Gathanju, the former moderator, is charged alongside James Muiruri Njane and Peter Mwangi Kamuthu with theft. His co-accused are employees of the church. 

Atambo issued the warning after the court was told that senior state counsel Christine Mbevi was not present as she has gone for an urgent training.

The court heard that the prosecutor received an urgent notice through a letter dated March 26, to attend to attend the two-day training.

The hearing was scheduled to start yesterday.

Defence lawyers Danstan Omari and Stanley Kang'ahi opposed the prosecution's application for adjournment, saying the office of the DPP has, for many times, failed taxpayers.

The accused have denied that on diverse dates between January 2, 2016, and June 30, 2017, jointly with others not before court, they conspired to steal Sh50,940,753 from PCEA head office at South C Estate in Nairobi.

They are also charged with forging signatures of Peter Kania Kariuki and Amon Nderi Ng'ang'a on an Equity Bank funds transfer form at Equity Bank, Nairobi West on January 20,2016, with intent to defraud them.

The accused are out on a Sh3 million bond each.
