MCAs, executive butt heads on removals from assembly

Embu MCAs on Thursday passed a motion denying the executive funds for allegedly meddling in the assembly squabbles.
Since April there have been wrangles after some assembly leaders were removed and replaced.
The MCAs stopped the Budget and Appropriations committee from handling any issue from the executive involving funds. They said this ban would last until determination of case filed by chief whip Margaret Kariuki and Mbeti North MCA Peter Muriithi against the committee.
The two were removed from the budget committee and have filed a case seeking reinstatement.
But the duo obtained court orders restraining the county assembly from removing them from the team. They had been replaced and the committee membership reduced from 11 to nine members.

The court temporarily reinstated them a week ago, pending outcome of the case. Other MCAs accused the executive of helping the two ward representatives to file the case.
They said they passed the motion for fear that if they continue with business, someone might go to court and claim they were violating its order. The MCAs said they have decided to give the court time.
Muminji MCA Newton Kariuki said the assembly is under attack from the executive. He was contributing to the motion moved by minority leader Lenny Mwaniki.
“The assembly has tried its best to refrain from reacting to the attacks. The time has come for the assembly to counter the move of the executive,” Kariuki said.
Other MCAs accused the court of meddling in operations of the assembly while it is supposed to be independent. They said the court should not have temporarily reinstated the two until the case is determined.
They include Majority leader Michael Njeru, Ruguru Ngandori MCA Harrison Muturi, deputy speaker Steve Munene, budget committee chairman Harrison Mwaluko and Evurore MCA Duncan Mbui.
Munene said the county assembly legal committee will write to Chief Justice David Maraga to protest against what they alleged is interference of the country assembly by the Embu court.
They said the court has occasionally granted orders against it when litigants seek them.
All MCAs present during the session supported the motion apart from Kagaari South MCA Robert Ireri, who said there are better ways of dealing with court orders, such as applying for its withdrawal.
