Court reinstates impeached Homa Bay speaker

A Kisumu court on Tuesday reinstated impeached Homa Bay speaker Elizabeth Ayoo pending determination of her case.

Last week, Homa Bay MCAs impeached Ayoo, saying her integrity had become questionable.

47 MCAs voted in favour of the motion that was moved by Ruma Kaksingri MCA Eliphalet Osuri.

They accused Ayoo of orchestrating last month’s chaos in the assembly during which deputy sergeant-at-arm Idah Arodi was arrested and charged.

Ayoo later filed an urgent application asking the court to reinstate her saying her ouster was unconstitutional and went against the house standing orders.

Ruling in her favour, Justice James Rika reinstated Ayoo to her position and barred MCAs and the county public service board from appointing any other person as speaker until the case is determined.

The judge said operations of the assembly would be hampered if the actions of the MCAs against Ayoo were left to stand.

“This is not merely an action based on an individual contract of employment. It involves the ability of a devolved unit to function, and the rights of citizens living in that unit, to receive services from the county assembly,” the judge said.

Judge Rika further ordered that the police provide security to Ayoo during her duties in her role as speaker.

The case will be mentioned before the Justice Nderi Nduma of the Employment and Labour Relations Court on December 4.
