Migori Governor Okoth Obado's personal assistant Michael Oyamo is expected to take plea over Sharon Otieno's murder at the Homa Bay High court on Tuesday.
Senior resident magistrate Lester Simiyu directed that Oyamo should appear in the court at 9am for the same.
She said it would be a violation of the suspect's rights should he continue being in custody since his arrest on Tuesday last week.
Simiyu granted the state 24 hours to hold the suspect and draw charges against Oyamo for him to take the plea.
"The state is given 24 hours from today to present before the judge an information concerning what the suspect has committed," the magistrate said.
The suspect is expected to appear before Justice Joseph Karanja of the Homa Bay High court for the plea taking.
The magistrate also directed that suspect would only be visited in custody by two of his lawyers and his brother George Oyamo.
The suspect lawyers are Neville Amolo, June Ashioya, and Rodgers Abisai.
"There should be nobody milling around the custody to access the suspect apart from the three people mentioned for purposes of his security," she said.
Earlier, Amolo argued the suspect's continuous detention in custody is a violation of his right considering that the law sets a 24-hour period after one's arrest.
The prosecution led by assistant director public prosecution Tom Imbali asked the court to grant them more time on grounds that they were still collecting more evidence.
Imbali said there some evidence like DNA samples from Oyamo which needs to be analysed before they draw charges against the suspect.
"We have a number of pieces of evidence which include communication messages and data which require more time to be analysed before we note down the charges against the suspect."
The prosecution requested to be given 10 more days to complete investigations.
During the proceedings, the magistrate asked the police not to harass the accused on grounds that everybody has the rights to be protected.
Oyamo appeared in court alone. Former Kanyadoto MCA Lawrence Mula, who was also arrested over the murder, did not appear.
Police said they will take Mula to court at an appropriate time.
