The Court on Friday summoned immigration officers to confirm whether Lucy Wambui Ngirita, the woman who is remanded together with her four children in the NYS scam has a passport.
Chief magistrate Douglas Ogoti said the officers should appear before him on Monday to confirm the status of her passport after conflicting details regarding the document were tabled in court.
Wambui had initially told the court that she does not have a passport, but later admitted she was issued with one in 2009.
She told the court that the passport got lost later and she applied for another passport in March last year.
The Court, early this week had directed her to bring a confirmation from the immigration office, but her lawyer Cliff Ombeta said they were yet to get a response.
Read:
“Your honour we wrote to the immigration and there was an indication that they will come to court today but they have not. We request that you summon the officers to come and tell the court the correct position” said Ombeta
The lawyer said Wambui is unwell and the prison authorities had ignored orders to accord her medication.
He said her continued stay in remand was worsening her condition.
In his ruling, the magistrate said the Directorate of Criminal Investigations (DCI) should also be involved in the process.
Wambui, and her daughters Ann Wambere, Phylis Njeri and son Jeremiah Gichini and his wife Catherine Wanjiku have been accused of receiving fraudulent payments from National Youth Service for goods not supplied.
They had earlier urged the court to reduce their bond terms saying they could not raise a total of Sh5 million after their accounts and assets were frozen by Assets Recovery Agency.
None has so far been cleared by the court and they are still in remand.
Wambui, however, has provided all the securities and surety to secure her release and is only wait for the court to clear her passport.
