Karua, Waiguru lawyers differ over admissibility of video evidence

Narc Kenya leader Martha Karua was on Wednesday tasked to explain whether she submitted a flash disk with video evidence in the petition against Governor Anne Waiguru.

Karua was taken to task by IEBC lawyer Joe Kathungu to explain whether the envelope she allegedly filed in court containing the flash disk was stamped at the court registry.

In her response, the former Gichugu MP told the Kerugoya High court she could not remember if the envelope was stamped.

On Monday, Karua alleged she had submitted a flash disk in the court registry.

She said the flash disk contains a video of a Jubilee party official bribing voters at Kangaru primary school polling station.

The flash disk has not been traced in court documents filed by Karua.

Waiguru's lawyers Paul Nyamodi amd Kamotho Waiganjo also denied being served with the flash disk.

"Your lady, I filed the flash disk in this court when I filed the petition alongside other documents. I also served the respondents with a DVD containing the same," she told Lady Justice Lucy Gitari.

Kathungu asked why Karua had not filed affidavits in her petition to back her claims she had filed the disk.

The Narc Kenya leader said she had not initially sworn affidavits to the same but indicated she did so when she raised the matter at the court of appeal.

Karua though insisted the flash disk was charged on the receipt when she filed her petition on September 5, last year.
